I believe an ebay seller sold me a pirated game?

i just bought call of duty world at war for the PC. i first ran it and it took an hour to install. when the game started up, it ran SLOW AS HE‌LL. too slow to be playable. so i ran updates that i should have done 4 months ago (one of them being an NVIDIA update [oops]). then when i tried to run it again. my computer wouldnt recognize the cd. it said: Please insert the correct DVD-ROM, select OK and restart application. so then i reinstalled it. this time it installed much faster. but it still comes up with that error when i try to run it. so im pretty sure that i was sold a pirated copy. can i report this to the law? i want to get the seller in trouble if he is indeed selling pirated copies of games. i hope he has to pay his life savings and end up in jail cuz thats the closest thing to hanging him upside down by his nutsack and shoving my boot up his as‌s
